The Legal Services Team deals with Clinical Negligence, Employer and Public Liability and all small claims as well as Coroners Investigations, Reports and attendance at Coroners Court, Small Claims, Patient, Solicitor and Police Access Requests as well as any legal issues that may arise such as consent queries, parental responsibility etc. The following training is available: Defensible Documentation, Consent and Capacity, Coroners, Advance Decisions/Living Wills.
Subject Access Requests and Access to Health Records are dealt with as part of the Legal Services Team functions. Instructions and forms to request access to information are provided below.
Access is provided under the following:
- The Data Protection Act 2018 (living persons records) - provides individuals (data subjects) with the right to access their personal data and can be exercised by an authorised representative on the individual's behalf.
- The Access to Health Records Act 1990 (deceased persons records) - provides access to deceased persons health records by authorised representatives
Access to any other type of recorded information held within the Trust should be requested under the Freedom of Information provisions.
The Legal Services Team is located in the Trust Headquarters at Leighton Hospital.
